​General Terms and Conditions

General

​​ These general conditions are an integral part of the contract concluded by HolidayMaldives, Abdullah Ma Al Mahmood sp (for the purpose of terms and conditions here by referred to as HolidayMaldives.eu) or an authorized agency on its behalf, and the passenger applying for a tourist package organized by HolidayMaldives.eu. In the event that an individual provision in the program is regulated differently than in these general conditions, the provisions stated in the program apply.

In the case of telephone or Internet sales, it is considered that the passenger has accepted the provisions of these general terms and conditions at the time he ordered the trip by telephone or Internet. The passenger can familiarize himself with the provisions of the general conditions on the website www.holidaymaldives.eu, where they are specially marked and generally accessible.

Subscriber or passenger is any person who has made a valid reservation or purchased/paid for a tourist package.

These general conditions do not apply to the purchase of air tickets and the sale of tourist packages organized by other providers, where HolidayMaldives.eu acts as an intermediary. In this case, the passenger is bound by the general terms and conditions of the organizer or air carrier and international legislation in this area. These general conditions do not apply to the insurance of health insurance with assistance abroad, where HolidayMaldives.eu acts as an intermediary. In this case, the insurance company's general conditions apply.  

Login

​ The traveler can apply for a tourist package organized by HolidayMaldives.eu at HolidayMaldives.eu or any authorized agency. The travel program is considered an offer. Based on the offer, the passenger applies in writing or verbally for the selected tourist package. Upon check-in, the passenger receives a HolidayMaldives.eu document (invoice/travel contract), which shows all the information about the ordered tourist package and additional services, as well as the payment schedule and any other agreements. The passenger is obliged to review the document and, in the event of any disagreement or error, report it within one day of its issuance. With the payment of the first installment (advance payment), the contract is considered concluded. When registering, the passenger is obliged to provide the required information and submit the documents required by the tourist package program and make the payment in accordance with the provisions of these general terms and conditions. In the event that the passenger does not provide the correct information at check-in, he is responsible for all costs or consequences arising from incorrect information.
Passenger registration is binding. It can be withdrawn in accordance with the provisions on the passenger's cancellation of the trip. In addition to the paid 1st installment of the invoice, any application or order submitted in oral or written form, which contains the name and surname of the passenger and other participants, credit card number or identification of another payment instrument, payment or partial payment of the price of the tourist package, is considered a binding application or other conclusive action indicating that the passenger has submitted a binding application.

The above conditions do not apply to tourist packages organized by HolidayMaldives.eu for closed groups or to tourist packages made to order (individual offers). In this case, the travel program is valid as an offer, and on the basis of the offer, the passenger applies in writing for the tourist package by filling out the application form, which is specially prepared based on the conditions of the program, or with any other written confirmation. By filling out the application form or submitting the passengers' personal data, the contract is considered to have been concluded and, in the event of cancellation of the tourist package, the passenger is obliged to settle all costs in accordance with the provisions on the cancellation of the trip by the passenger.

According to the contract, HolidayMaldives.eu is obliged to provide the passenger with services that have the content and features as announced in the contract or the tourist package program and to take care of the rights and interests of the passenger in accordance with good business practices.

The passenger is obliged to ensure that he personally, his personal documents and his luggage meet the conditions prescribed by border, customs, sanitary, monetary and other administrative regulations. HolidayMaldives.eu has the right to refuse the registration of a passenger whom it can reasonably assume in advance does not meet these conditions or might not meet them during the trip.  

Airline tickets

​​ The price of the plane ticket is included in the price display on the website only so that the customer has a better overview of the price. The airline ticket is paid to the external partner/agency that issues the tickets. If desired, the customer can also find a return ticket himself, so the flight ticket is not included in the arrangement (legal and formal obligations and rights from the purchase of the flight ticket are therefore between the passenger and the agency that issues the ticket. HolidayMaldives.eu is not responsible for the flight and is not responsible for the choice of the carrier by the passengers.The passenger chooses the carrier according to his wishes and criteria and is responsible for his choice.  

Registration fee and security deposit

​​ For its services, HolidayMaldives.eu charges the client standard reservation costs and costs for the composition of the offer when selling tourist packages in accordance with the tender for each reservation. HolidayMaldives.eu may set different booking costs for individual tourist packages. In the case of more complex offers on request for individual trips, HolidayMaldives.eu may charge the traveler EUR 25,00 as a deposit for making the offer. If the passenger does not accept the offer, the deposit is not returned.  

Payment

​​ The day of payment is considered the day when the traveler makes the payment directly to HolidayMaldives.eu or an authorized agency, or when HolidayMaldives.eu receives the payment to the transaction account. Upon check-in, the passenger is obliged to pay an advance payment of EUR 200 per passenger, or as much as stated in the travel program. The balance up to the full price is paid no later than 30 days before departure, or as stated in the notice or program.

Timely payment means a confirmed reservation. If the passenger does not pay within the agreed period, this means the cancellation of the tourist package and the provisions on the cancellation of the tourist package by the passenger shall be applied accordingly. The traveler undertakes to pay the difference that would arise due to a possible calculation error on the document issued by HolidayMaldives.eu, and HolidayMaldives.eu undertakes to return to the traveler any overcharged amount resulting from the calculation error. This obligation is valid until the end of the financial year.

HolidayMaldives.eu may stipulate in the program that the traveler pays certain services to be provided on site to its representative ("mandatory on site surcharge"). In this case, HolidayMaldives.eu acts neither as an organizer nor as an intermediary, but only as an informer. In this case, the passenger claims all complaints exclusively from the service provider on the spot.

When a tourist package is booked for a passenger by an authorized travel agency, all the provisions of this point apply mutatis mutandis to the authorized travel agency.
If the passenger does not pay within the agreed period, this means the cancellation of the tourist package and the provisions on the cancellation of the tourist package by the passenger shall be applied accordingly.  

Prices

​​ The prices of the tourist package are determined by the program and are valid from the date of publication of the program until the change. The price includes the services listed in the tourist package program. The price valid for the passenger is on the date of conclusion of the contract/issuance of the invoice.

In accordance with the applicable legislation, HolidayMaldives.eu may change this price even after the conclusion of the contract, namely due to changes in the exchange rate or due to changes in carrier tariffs that affect the price of the tourist package. In the event of a price change from this address, HolidayMaldives.eu shall notify the passenger or the authorized travel agency that made the reservation in writing no later than 20 (twenty) days before departure, and issue an additional document (invoice) that the passenger is obliged to pay before departure.

The price change due to exchange rate differences is calculated as the difference in the value of that part of the costs that are expressed/calculated in foreign currency, and is calculated according to the exchange rate (1) of the foreign currency on the day of preparation of the tourist package (planned price according to the offer) and (2) on the day of preparation of the price change notification (usually 20-23 days before departure). The exchange rate of the Bank of Slovenia is taken into account for the conversion.

If the increase in the agreed price exceeds 8 percent of the price of the tourist package, the consumer can withdraw from the contract without having to compensate for the damage. In this case, HolidayMaldives.eu will refund the amount paid to the passenger.   

HolidayMaldives.eu also sets a starting price in the tourist package program for a certain number of passengers, which can be changed if a smaller number of passengers apply for the trip. HolidayMaldives.eu lists this additional price in the program as a "mandatory surcharge in case of group size from/to persons". Upon registration, HolidayMaldives.eu charges the passenger the starting price of the trip. If the conditions for a price change under "smaller groups" arise, the passenger cannot withdraw from the contract, as he was aware of them at the time of check-in.    

Severance pay

​ When registering, the passenger decides to take out insurance in case of cancellation. Insurance is taken out directly with the insurance company. The terms of the termination fee are determined by the insurance company's general terms and conditions and are consistent with its valid price list.

Special services

​​ Special services are those services which, as a rule, are not included in the price of the tourist package (single room, special meals, other optional extras...) or for which extras are foreseen in the program (visas, other extras, etc.), so the passenger pays them separately , unless otherwise specified in the program.

In the event that special services are advertised for an individual tourist package, the passenger conveys his wishes for these services at the time of registration, and pays for them in addition to the price of the trip. The published prices of special services are only valid if these services are ordered and paid for when registering for a trip. During the trip, the passenger pays extra for special services to the tour manager or HolidayMaldives.eu representative in the place where the service is provided, in the appropriate currency, if this service can still be ordered during the trip, at the price valid on the spot.

If the traveler applies for a tourist package by himself, he can leave it to HolidayMaldives.eu to find him a fellow traveler with whom he will share a room, or who is willing to share a room with him. Regardless of the above, the individual registered passenger must pay extra for a single room upon check-in. 

In the event that a companion is found for an individually registered passenger, the additional payment for a single room will be refunded to the passenger after the trip. In the event that two people who are in the same room sign up for the tourist package, and one of them cancels the tourist package before the trip, the other passenger bears the costs of the single room supplement if it is not possible to find another passenger. You participate in all excursions at your own risk. 

When registering, the passenger decides to take out insurance in case of cancellation. Insurance is taken out directly with the insurance company. The terms of the termination fee are determined by the insurance company's general terms and conditions and are consistent with its valid price list.  

The passenger's change of contract or cancellation of the tourist package

​​ The traveler has the right to request a change to the contract (e.g. change of name, additional services, change of accommodation, etc.) after its conclusion, and HolidayMaldives.eu is obliged to check if this is even possible. In the event of a change to the contract at the request of the passenger, HolidayMaldives.eu may charge the passenger administrative costs in the amount of EUR 25,00 for the change, unless otherwise specified in these general terms and conditions.

The passenger has the right to cancel the tourist package. In the event that the traveler cancels the tourist package, HolidayMaldives.eu has the right to reimburse the costs, which depend on the time left until the start of the trip. In any case, HolidayMaldives.eu requests a refund of the administration costs of the reservation in the amount of EUR 25,00. Unless otherwise specified in the program, the following cancellation fees apply: 

For tourist packages:

• cancellation up to 45 days before departure, 20% of the price of the arrangement,
• cancellation from 44 to 30 days before departure, 30% of the price of the arrangement,
• cancellation from 29 to 22 days before departure, 50% of the price of the arrangement,
• cancellation 21 to 15 days before departure, 80% of the price of the arrangement,
• cancellation later than 15 days before departure, 100% of the price of the arrangement.

Irrespective of the cancellation costs specified above, they may be different when dictated by the terms of organizing the trip, i.e. dictated by HolidayMaldives.eu's valid terms of sale and/or stipulated by business partners.
Regardless of the costs specified above, the cancellation costs may also be different if they are specified in the tour package program or contract.

When canceling a tourist package before departure, the passenger submits a written cancellation or signs a cancellation document issued by HolidayMaldives.eu. If the passenger refuses to sign or confirm this document, it is considered that he has not canceled the trip. During the trip, the passenger can interrupt the tourist package at his request. If the passenger interrupts the tourist package during the trip, he does not have the right to a refund of the costs or the purchase price, either in part or in full, upon his return. If during the trip the passenger changes the program at will or does not travel according to the program that is an integral part of the contract with HolidayMaldives.eu, the passenger is considered to have withdrawn from the contract during the trip. In this case, the passenger is responsible for the costs and damage caused by it.
In the event of a program change at their own request or due to force majeure, without there being any reason for this on the part of HolidayMaldives.eu due to improperly performed service, the passenger has no right to request any compensation or price reduction.
 
HolidayMaldives.eu, or an authorized person, may refuse a person at any time before the trip or on the day of departure, when it assesses that the passenger could endanger the health or property of himself or others, or who is clearly under the influence of alcohol, drugs or other such substances at the time of departure. In this case, HolidayMaldives.eu acts according to the provisions on the passenger's cancellation.

HolidayMaldives.eu has the right during the trip to ask the passenger to interrupt the joint journey with the group if he does not ensure that he personally, his personal documents and his luggage meet the conditions prescribed by border, customs, sanitary, monetary and other regulations, or if he is clearly under the influence of alcohol, drugs or other such substances, or if he behaves inappropriately towards other passengers and his exclusion is requested by the group.

In this case, HolidayMaldives.eu acts according to the provisions on the passenger's cancellation.

HolidayMaldives.eu will claim all damages caused by the traveler's inappropriate behavior on the way or during the duration of the tour package.

The amount of cancellation costs of the tourist package in the event that HolidayMaldives.eu is not the tour operator is determined by the general terms and conditions or another act of the operator.  

The organizer changes the program or cancels the trip

​​ In accordance with current legislation, HolidayMaldives.eu reserves the right to cancel the tourist package if the minimum required number of passengers specified in the program is not signed up for the tourist package. HolidayMaldives.eu informs the traveler about the withdrawal of the contract if the minimum number of travelers has not registered, no later than:
 
- 20 days before the start of the tourist package that lasts more than 6 days,
- 7 days before the start of the tourist package that lasts from 2 to 6 days,
– 2 days (48 hours) before the start of the tourist package that lasts less than 2 days.

In cases where HolidayMaldives.eu expressly guarantees the departure in writing, it cannot cancel the tour package, unless fewer than the minimum number of passengers provided for in the program are registered.

HolidayMaldives.eu reserves the right to fully or partially withdraw from the contract if extraordinary circumstances occur before or during the implementation of the program that could not be expected, removed or avoided, and for HolidayMaldives.eu these circumstances represent a valid reason to would not have concluded the contract if they existed at the time of the conclusion of the contract.

HolidayMaldives.eu may terminate the contract or withdraw from the contract and demand reimbursement of damages from the passenger who directly violates the provisions of the contract concluded with HolidayMaldives.eu, especially if it is established that the passenger has intentionally provided incorrect information about the number of passengers or their age , or changes occurred during the trip, and the passenger did not inform HolidayMaldives.eu about this.

HolidayMaldives.eu reserves the right (and is not responsible) for changes to the date and time of departure or for cancellations of the tourist package due to changes in the flight schedule or force majeure, and the right to change the direction of the trip if the conditions for the trip change (new schedule, uncertain situation in the country where the program is organized, natural disasters or other unforeseen causes beyond HolidayMaldives.eu's control), without special compensation and according to the applicable regulations in passenger traffic.

The responsibility of HolidayMaldives.eu is limited only to the non-implementation of a certain part of the program, in the part that entails relevant material costs. HolidayMaldives.eu is not responsible for non-material damage resulting from delays, cancellations or changes to transport or means of transport. HolidayMaldives.eu cannot take responsibility for changes to the program due to the occurrence of any force majeure during the course of the program. In these cases, it can provide passengers with services in a modified form, based on existing options. In the event that HolidayMaldives.eu cancels the tourist package, the traveler has the right to a full refund of the paid price of the arrangement, but does not have the right to a refund of visa costs or vaccination costs that were required by the program. HolidayMaldives.eu will notify the traveler immediately of any subsequent changes to the program.

In the event that the situation on the spot of HolidayMaldives.eu does not allow the accommodation of passengers in the ordered facility, HolidayMaldives.eu can accommodate the passenger in the same location in another facility of the same or higher category.  

Travel documents

​​ The passenger must have a valid passport or other valid document with which he can enter the country he is traveling to or through. The passenger is obliged to pay attention to all provisions regarding the validity of the travel document. The validity of the document is taken into account on the last day of travel. HolidayMaldives.eu is not responsible for any inconvenience or forced interruption of the passenger's trip due to this.

The passenger is obliged to obtain the visas required for these countries. If the passenger does not fulfill this obligation, HolidayMaldives.eu acts according to the provisions on the cancellation of the tourist package by the passenger. In the event that the traveler is issued with an A visa by HolidayMaldives.eu, it does not guarantee the success of obtaining the visa. HolidayMaldives.eu does not refund the cost of obtaining visas to the passenger. In case of refusal of entry into the country or other obstacles, all costs are borne by the passenger himself. It is considered that the traveler arranges the visa himself if HolidayMaldives.eu does not deliver all the necessary documents within the prescribed period, regardless of whether the traveler has already paid for the acquisition of these documents at HolidayMaldives.eu.

Due to the requirements in international passenger traffic (air, ship, bus, etc.), the passenger is obliged to provide all the necessary information about all the participants of the trip that he/she is registering at the time of registration. The information must fully match the information in the official documents that the participants of the trip are obliged to carry with them in accordance with the regulations on crossing the state border and relevant foreign legislative acts. In the event that incorrect information causes delay, additional costs or interruption of the trip for other travel participants, the traveler himself is responsible for all incurred costs for the travel participants.

If the passenger loses documents during the trip or they are stolen, but they are absolutely necessary to continue the trip or to return to the homeland, the passenger must obtain new ones at his own expense. In the event that the passenger has to interrupt the tourist package due to the loss or theft of documents, he is not entitled to any reimbursement of the paid tourist package or reimbursement of costs  

Notifications before departure

​ The passenger receives the final notification no later than 5 (five) days before departure. Any damage caused by the passenger providing an incomplete or incorrect address shall be borne by the passenger. In the event that the passenger does not receive the notification within the specified period, he is obliged to report himself at his check-in point and request it. HolidayMaldives.eu does not consider complaints from undelivered mail.

Health regulations

​ The passenger is obliged to take the vaccinations required for the country of travel. If certain vaccinations are specified or required in the travel program, each passenger must obtain an international certificate - a yellow booklet with recorded vaccinations. HolidayMaldives.eu is not responsible for possible complications or the passenger's interruption of the tourist package due to the passenger's non-compliance with the health regulations of the country he is entering, as well as for the costs related to this.

Customs and foreign exchange regulations

​ The passenger is obliged to comply with all customs and foreign exchange regulations of the Republic of Slovenia, as well as the regulations of all other countries to and through which he is traveling. If, due to non-compliance with the regulations, the passenger could not continue the journey, he/she bears all the consequences and costs incurred in this connection for him/her and all other fellow passengers.

Photos and videos during the trip

​ By registering for the trip, you also agree that we can use the photos taken during the trips for our advertising purposes (brochures, web, articles, social networks). The passenger can inform us in writing or verbally that he does not want his pictures to be published.

Luggage

​​ HolidayMaldives.eu is not responsible for the transport, theft or damage of passengers' luggage or other personal belongings, valuables and documents from accommodation facilities (hotel rooms, apartments, etc.) and means of transport (planes, buses, ships, etc.).

The passenger must report lost or damaged luggage to the carrier or hotel. Transportation of special luggage (such as bicycles, surfboards, golf equipment, skis, musical instruments, etc.) must be announced by the passenger at check-in and paid to the carrier in accordance with the carrier's rules, unless otherwise specified in the tourist package program. All costs or damage that would arise as a result are borne by the passenger himself.

 During transportation, the passenger has the right to free transportation of a certain weight of luggage (according to the carrier's regulations), and each additional kilogram is paid by the passenger himself on the spot in the appropriate currency or according to the carrier's regulations. Children under the age of two are not entitled to free baggage transportation. With a low-cost carrier, the allowed weight of baggage that a passenger checks in at the time of check-in for a flight is usually lower than that allowed with regular carriers. Each extra kilogram is charged extra. The permitted weight of personal luggage that a passenger takes with him on the plane may also be lower, and passengers are informed of this at the latest with a notice before departure.  

Complaints

​​ The passenger is obliged to report irregularities to the HolidayMaldives.eu representative on the spot when they occur. In the event that the complaint could be resolved on the spot (for example, insufficient cleanliness of the room, equipment, location of the room, etc.), but the passenger did not report the error or irregularities to the representative of the agency, it is considered that the passenger has agreed to such a service and thus has lost the right to file later complaints.

The passenger can file a written complaint within two months from the day the service was improperly provided, otherwise HolidayMaldives.eu will not deal with the content. The complaint must be justified. The passenger should therefore attach relevant evidence and/or an appropriate certificate from the hotelier, carrier or other relevant person to the complaint about the actual situation, on the basis of which the passenger asserts his claim.

HolidayMaldives.eu is obliged to respond in writing to the complaint within 8 days of its receipt. If it is a simple deficiency and the error is not in dispute (or if the passenger did not attach all the necessary documents within the time required to obtain them), HolidayMaldives.eu is obliged to comply with the request after receiving a complete complaint request.

If the error is not simple, HolidayMaldives.eu is obliged to investigate all the circumstances that led to the complaint. Until Holidaymaldives.eu decides on the appeal, the traveler refrains from communicating with any other person, judicial institutions or giving information to public media.

The amount of compensation is limited by the amount of the price of the paid trip or by the amount of the real value of the services not performed. This provision does not apply in the event that HolidayMaldives.eu has the right to cancel the arrangement or change the program, in accordance with the provisions of these general conditions and the law.

Regardless of the complaint filed, the passenger is obliged to settle his obligations according to the issued invoices for the service provided in accordance with the payment schedule, and any compensation is paid to the passenger's personal account after the complaint procedure has been completed.      

Responsibility for punctuality of air carriers

​ HolidayMaldives.eu is not responsible for the punctuality of air transport on regular or non-scheduled flights, nor for plane delays, nor for changes to the passenger's journey that would occur as a result of such delays. 

Use of data

​ HolidayMaldives.eu protects all acquired passenger data in accordance with the Personal Data Protection Act. HolidayMaldives.eu processes all obtained passenger data in accordance with the Personal Data Protection Policy, available at www.holidayMaldives.eu

Final Provisions

​ In the event of a dispute between the parties, the competent court shall be used.
